Apparently it's mostly the pilot's fault. He knew that the amount of fuel would just barely get him to Medellin. When he got near Bogota he could have stopped for more fuel, but didn't. When he went on emergency fuel (which lasts half an hour, which is more than enough time for flight control to set up an emergency landing), he didn't contact flight control (it's mandatory for a pilot to immediately contact them as soon as they start running on emergency fuel, but he waited until just a few minutes before he completely ran out).
The reason? If someone starts a flight without enough fuel and has to stop for more or run on emergency fuel, both the pilot and the flight company (which btw it just happened to be the case that it was partly owned by the pilot) are heavily fined. So it basicly looks like he put everyone in fatal danger just to avoid a fine... he miscalculated and took a the chance, and it went wrong.
That is the most likely explanation for now. Unless perhaps there was indeed some kind of emergency fuel leak, which made it impossible for him to contact flight control before it was too late.
