After some googling it looks like that's the kosher way to allow him to play in the KHL. Devils terminated Kovalchuk when he left too.
I think it also gets him around the 30 owners having to approve his return so they can sign him to a 1 day contract and have him retire a red wing without his being out of hockey for a year.
