i dont think he can settle out of court right?

i think i read something that they have sufficient evidence so they will prosecute with or with out cooperation from the victim

Yes and no. Kobe settled out of court.
Problem with rape is, the evidence they have from rape kits just shows sexual intercourse occurred, they need the victim's account to pursue criminal charges and a lot of times settling includes signing an agreement to not testify. It's not as easy as, say, voynov's case where there was visible damage and you can't exactly consent to getting thrown into a TV in a drunken rage.

They can pursue it but they won't get far.

kobe settled only because the woman didn't testify, so charges had to be dropped. like you say.
but koj saying with or without the testimony they can pursue?

No way they can prosecute if the victim doesnt cooperate, kane lawyer will eat them out no matter what evidence they have

Criminal charges are brought by the state, not by the person - so for any crime they can pursue. Pointing again to Voynov, they prosecuted him despite the fact his wife refused to testify, because they had evidence that she showed up battered and bruised at the hospital and waywardly said he did it to her at the time.
Again though, the physical evidence would just be a rape kit that says he had intercourse with her - those can't tell if it was forced, and obviously can't tell if she said no. Without her actively saying it was rape, it's gonna be tough to get a jury to convict.
