You should be able to get close enough to it when you're on the street, or even take a few steps into their driveway.
Haven't come across a Pokemon that was in somebody's backyard lol.
Because of the three step glitch if he knows they're there then either he sees them on his screen and can catch them or someone else told him they're there in which case he can just do whatever that person did.
