You make so many bullshit assumptions that are based on nothing. It's actually impressive.
1. You don't know it was eliminated, he still could have been reaching for something
2. Not if it looked like there was an imminent threat. Doesn't matter if there was, if a person could reasonably think the guy was gonna do something negotiation time is over
