Saying they can't participate leaves gray area for JSP to come in and say Tom scammed the fg by not refunding it.

Happened in poker often before. People will get locked.

If Tom is at risk in any way then yes, return the fg. Tom should not be put in the position where he will be breaking the rules of the site.

Plenty of people have had fg kept as a donation as welchers. The only difference here is that "no welchers allowed" =/= "we will keep any welcher fg."
If you were really only looking out for Tom you would just post "okay, keep the fg as a donation to the pot."

He did offer up to give the teams to fans of the team which seemed fair to me. Not like they were picks from his friends for say.

I agree it's fair, I'm just saying if he were "just looking out for Tom" he'd let Tom completely off the hook with one quick post. Instead he's asserting power by stipulating who it goes to.
