Unfortunately the driver will probably be blamed.
Kids riding around on scooters and skateboards this morning on my way to the gym, looking at phone they didn't even look before crossing.. luckily I was waiting to turn and expected them to not pay attention.

But it could have been the driver playing the game and not watching what was going on.
