being a Shinighami atutomaticaly means u must weild a zanpakuto
if Yoruichi doesnt have a zanpakuto then she simply aint a shinighami

by stating that she doesnt have a zanpakuto then it means she is NOT a shinighami
which is impossible since she was a captain in Gotei 13

anyhow, he is not mentioned as a Shinigami, yet he's a captain.
at the bottom of the powers and abilities it says

Tessai's Zanpakutō has not yet been revealed.

Shikai: Not Yet Revealed

Bankai: Not Yet Revealed

doesn't mean he's a shinigami either. the trusty source you're talking about assumes he's a Shinigami already.
yet 101 years ago, he's only carrying a staff.

yoruichi used her zanpakto once in i the OVA sealed sword frenzy and it was shown in the flashbacks when she told ichigo about uruhara
she has a zanpakto and by your logic that would mean she is a shinigami but it is never confirmed by the author so she could be anything

I said its impossible NOT BEING A SHINIGHAMI since she was captain of
a SHINIGHAMI SQUAD before.
I am 100% sure she IS a SHINIGHAMI.

as for tessai he IS a shinighami too.
Take a look at hachi. He doesnt hold his zanpakuto but still he SUMMONS IT via KIDO.
I bet the same goes for Tessai. Either he can summon it via kido or his staff was his zanpakuto *(something like Captain Commader's one)

i agreed with you that she is a shinigami, but the author never confirmed it so she could be anything
ichigo also has a zanpakto but isn't 100% shinigami

yeah maybe she is a big flying pony disguised as a shinighami to confuse people like us
