They don't a regular fruit turns into a devil fruit after the user dies.
When smiley died a nearby apple turned into the devil fruit.

Speculation: The same type of fruit it was originally turns into the devil fruit and the closest fruit of that type of fruit turns into a devil fruit.

There are artifical devil fruits. It was first shown when Momonosuke ate one. They are all Zoan types in which Kaidou has an 'army' full of these users.

We know that the apple that turned into the devil fruit is legit. It happened on the spot, as well as it has the markings of a devil fruit. -- The artificial devil fruit Zoan types that Caesar made are with circles.

If anything, Caesar had a load of apples nearby so the assumption would definitely be when a fruit user is dead, the same fruit nearby would then turn into the same Devil Fruit. However, this questions a bit on why Caesar had multiple apples instead of just one, unless that # isn't even a factor. Cuz if it mattered, Im sure he'd had a shit ton of apples. And what if Sanji had apples in the kitchen of Sunny-go, or if someone was already holding an apple, assuming that the new Devil Fruit can only be on the fruit that is not already been partly eaten that is. It could be another assumption that most devil fruit users in the past did not realize they ate one (Just a thought).

Until this professor gives us a complete explanation, this is definitely the only thing that we can go with. Seeing as how the Mera Mera fruit has the markings of a devil fruit. It is (within the assumption of the markings as proof) the real thing.
