Go back and read what Kakashi said, "
this fight was over the moment I was caught".
The fight was between Kakashi and Zabuza. Naruto, Sasuke and Sakura were ordered to stay back and protect Tazuna. Ergo, they were not part of the fight.
Clearly if there are only two parties to a fight and one acknowledges the fight is over he has admitted defeat.
It was obvious to everyone that Naruto, Sasuke and Sakura couldn't beat Zabuza.
Kakashi and Zabuza both knew the outcome of their fight would determine the fate of Tazuna and the others.

Then zabuza showed up and got him in the water prison. I remember, I watched these episodes like 20 times on cartoon network before I started downloading.
and in the end, neji hyuuga got out of the water prison that the kisame water clones were using, so I think Kakashi could have done the same. Water prison isn't a finishing move I wouldn't think.

A scenario where Kakashi jumps into a
river against a Ninja from the hidden Mist village, who he knows is an adept in the element of
Water, is not one.

He chose not to do anything to Kakashi once he was imprisoned because he wanted to deal with Tazuna (I can post a picture of this too if you would like).
Zabuza knew Kakashi was out of the picture as soon as he was captured. The fact he subsequently underestimated the genin ultimately proved fatal to him.
