like the kitty lady said your first realesd is called shikai, knowing your swords name and changing its form

2nd realesed is bankai, your sword transform to a much more powerful form

so no his shikai isnt realesed

edit: sangetsu himself said to ichigo that kenpachi cant hear his sword speak when he's figting because of his riatsu
and when he dont fight his sword would be too pissed off at him to even talk at all

also

no before he was a shinigami his sword was always like that!!
it shows on the flash back when he first meet his vice capt when she was still a baby!

and no its not on the shikai released its just a normal katana that is broken
and remember after he fought ichigo he said he got beatern fair and square?
his vice capt said no it was 2 vs 1 (ichigo and sangetsu vs kenpachi)

Kenpachi is THE ONLY exception to the rule. He cant seal his sword, therefore he cant release it. It is always released. Yes, if he learned the swords name he would gain in strength because the struggle between himself and the sword would most likely end. But it doesn't change the FACT that it is and has always been released. It is there in black in white in more then one instance in the manga. The junk swords the lower class shinigami carry around are just that JUNK known as a asauchi. They are not the same type of sword the higher ranking shinigami of SS carry around. This is also plainly stated. Let me reiterate that I'm not trying to argue that Kenpachi can't learn new abilities with his sword. Once he learns his swords name this is and inevitability. I'm just stating the fact that his sword is already in its released form.
