Exactly. Hell, Orochimaru figured out a way to beat time and not die of old age. Who's to say that one of the sons couldn't? Either way, no one is going to be correct about this. Don't get me wrong, the elder son of the Sage isn't my #1 choice for who Tobi is, but I'm not ruling him out. I think it helps to be more open-minded.

orochimaru was already dead... all itachi did was seal the left over chakra from that cursed seal and get rid of the little traces left behind
