PLUS if he was alive, he couldnt have been tobi when nine tails attacked konoha protected by 4th hokage (kak, rin, obito all disciples under 4th still)

why? because he cant suddenly become an old like tobi and have mastery over sharingan in such a short period of time

he would be a teenager, could have been adult size by then

and we don't know whether or not rin was dead or alive at the time

IF obito had killed rin years before, it's very possible that he could have mastered the MS enough to control the kyuubi


he also might have had help from zetsu, who was around since the first war, and seems to be a common element in the story
