Kabuto even said himself that Jiraiya was too far underwater to get a DNA sample from. Also, if Nagato was able to defeat Jiraiya, then why would he be considered an ultimate trump card? Don't get me wrong, he's one of the most powerful in the series but he's not exactly "top top tier." We're looking at a good guy. Kakashi or Naruto.

only on the last chapter, he used too much chakra and have to rest for a bit before he can use shadow cloone and stay on that mode.

it was only when he had to fight the kyuubi and take his chakra into himself that he couldnt make clones or else he would get consumed (i think)
