there's a big difference between kakashi and gaara's death, then the edo tensei people's death. i don't even know why you're using edo tensei as your support because there's a huge difference between the edo tensei people and gaara/kakash. it just makes your argument weak and might i add, stupid.
in case you want to know the difference (if you're too slow to figure it out yourself), i'll go ahead and explain:
the people of edo tensei are those confirmed dead and have been dead for quite awhile, and they're people who are practically immortal and pretty much no longer human, nor do they bleed... gaara and kakashi are still able to die with a stab to the heart or other vital organs aka they're mortals..not to mention, their resurrections seem to have a time frame in that they have to be revived not too long after their death (hence why jiraiya wasn't revived)
but yes, my point was that unless they're confirmed 100% totally dead and won't walk the earth as a mortal again, deaths that are merely "reported" don't mean crap unless they are 100% totally confirmed dead and won't walk the earth as a mortal again. so it's pretty much fair game as to who tobi is unless there is proof beyond a reasonable doubt
