1. Downloading English dub or licensed anime.
2. Selling or using for profit without license.
3. Claiming it as your own work.
If your download is not classified under either of those you are good to go.

If you want to get technical, it's still not blatantly illegal. It is only illegal if the company decides to file a complaint. The whole anime industry is based on the fan database and the world wide distribution which Japan is aware of. Otherwise anime would be10% as strong of today's. Also the fair use clause makes it ambiguous as to whether it is illegal or not.
In simple terms for your dumb ass, it's illegal if the company deems it illegal. There is no law specifically stating fansubbing and related activities is unlawful.
If you want proof, many large anime sites that have downloads have been contacted to remove licensed material, ONLY LICENSED.
