Anyways you are safe from everything if you use a private torrent site. They can tell you torrent bit not what you are torrenting, they basically send the letters out to people who torrent a lot as a scare tactic. They can't do shit in reality.
Wrong. You can get list of peers for given torrent hash. Anyone can view the swarm of any public torrent. HBO can literally fetch torrent from public tracker and see who has how many % and test if he's uploading.
But as you said: private trackers ftw. BTN allowed this upload *hint hint*. What they can do in reality depends on jurisdiction. People in Germany get in a lot of shit for torrenting publicly. Or, basically, 1000 euro fine.
