Wouldn't Jon be an illegitimate child though, since Rhaegar and Lyanna didn't marry?
Whether or not they got married is still up for debate. Clues in the book indicate that they probably did get married on the Isle of Faces, meaning Brann will be able to see it.
The next question, though, is: Who will know that they got married and be able to to prove it in a way that actually has political backing? That's where the theory of Howland Reed = High Sparrow starts to fit in a little (though it is still a weak theory overall).
Now that I think about it, the show is taking some big liberties because there is no way that Brann could have been able to see the ToJ scene as there was most certainly no weirwood tree anywhere near there.
