Huh? OEM and MSDN have nothing to do with each other. Of course it doesn't. That's the ToS for MSDN.

You will not find any certified retailer that sells OEM keys without the CD/product box or as part of a pre-built system. The purpose of OEM keys is to be installed on systems that you're building to sell.

Because Kinguin isn't selling the keys. Just like they can't shutdown 3bay. It's a marketplace. It's users (like me or you) that sign up and start selling. Anyone can do it.
