Tooltips in D4 can be unreliable... surprisingly

Does anyone know, does the fury have to "spent" on a skill, or can this be passive fury lost from Selig ticks?

I guess its only when you actively spend. But idk. Just stand in a crowd and see what happens? I mean you could easily test this, no?
