No they aren't. You bring up Smugglers vs Agents, if you play Imperial most Imps feel Smugglers are unfairly advantaged compared to Agents. The classes ate similar, all the diffrences don't mean much to decent players. Bioware hasn't done anything wrong.

Republic players want transfers to Pub heavy servers, Imps don't want to leave our server if were not having trouble. Same with pub players who aren't.
Locking down a faction would end Korriban and Hutta and cut off the population on the early planets. Also if you didn't already have a character for all classes you have to wait.
Incentives aren't fair to the rest of the people. Servers will balance themselves out. My server used to have a 5:1 imbalance, it went down to 2:1, now its at 1.5:1. And mine is one of the heaviest populated servers.
