Actually.. the 25/40 restrictions was in 2.6 Legacy before the game changed to 3.0 where they removed cruel/merciless..

Technically you could be level 1 using vendor recipe called the Book of Regression: 1 Scour + 1 Wisdom Scroll.
Make sure to have as many passive points unallocated for as many as you want to de-level.

and yes there was level requirements to get past each one
