Okay so I was at a party at my friends house and I was the only person there that was 21 (everyone else was like 16-19).

There was beer there and stuff, the police got everyones name and such.

The beer was mine from the night before and Iby the time I even got there the beer was gone (I got there at 1:30, police came at 2:00 AM)

Can I be charged with distribution to minors?

The laws very from state to state & city/county to city/county

U sould contact ur local Law Enforcement agency or legal consoltant (lawyer) for clarification of te laws governing ur area

I think that since you did not own the beer at the time when they were alll drinking it, and you did not "encourage" the drinking of beer, since it was gone when you got there, you should be safe.

I would suggest directing ur question to a qualified legal representative in ur area

Some areas may require u to be observed with alcohol in ur posesion @ the time & others may see it as u were the only "of age" individual there & therfor ur responsability

But ur local Legal Consultatnt would be a better qualified person to give u advice on ur perticular situation

It depends on the state and city/county.

Ill give you one example,

In the area I live in, in one city you can be charged for underage drinking if you're at a party and nothing is in your hand, while in another city in my county, we have to see one in your hand to charge you.

Plus, officer discretion plays a big role in whether you will be charged or not. Just tell them the story and be as remorseful as possible. Honesty goes a long way.
