I took a pre-employment drug test today and tested positive for marijuana


I do not smoke marijuana and have not smoked marijuana for approximately 5 or more months


I have however smoked "spice" which is, or at least was legal in my area at the time.


Now the drug testing lab is telling me that I have to pay $125 to have the same sample re-tested.


The location that they took my drug test at, as well as the place of employment will not even tell me what the name of the lab that did the actual testing is.


I think it is preposterous, what if the sample has been contaminated?


The job is for a walmart subdevision and a failed drug tests renders me inelligable for employment for a year.


I was told if I do contest the drug test and it is found to be a false positive that the job would still be available to me.


I also was very upset when I was called and told that I tested positive, and neglected to ask my level of THC, which would have been a contributing factor in my decisions.


But I really could use some help or advice on this situation and need to know; Has anyone else had a false positive for marijuana?


The test is Escreen/Ecup.


Has anyone failed a drug test for Ecup?

I was told I would receive the paperwork to contest it in the mail

Will that paperwork show my levels of THC?



Is it possible that I had enough THC in my system after 4~6 months that I would test positive?

if you were a really heavy smoker it could stay in your system for quite a while

You didn't have THC in your system if you didn't smoke in over 5 months. The problem is that you smoked something that will be illegal, but isn't yet, and is structurally similar to delta 9 THC, the active ingredient in marijuana. Lab tests are based on structure of molecules, not function, so you basically set it off by smoking something similar. Don't pay for the retake, it'll be the same thing again.

It took me approximately 13 days to smoke a quarter bag of low grade reggie


i smoked about half a gram a day

But it is not marijuana?

So I will be ineligable for employment and also did not get the job because of something that is false.

Marijuana leaves your system completely after about 15-20 days, the month this is exaggerated.

Make sure you tested posative for THC and not JWH-018 (active ingredient in spice) because as long as you smoked the spice before it was criminalized (which they can't prove you didn't because the results are vague) you can't get in trouble.

Most people don't know this so they try and get people with it.
Just like how it's unlawful for cops to check a school bag, but they do it anyway if you don't know.

Threaten them with a lawsuit because it's unlawful to withhold information of such caliber about a job.

Everyone's out to fuck you, and will do so if they know you'll do nothing about it. ^^

i don't think walmart cares if it was legal or not. They still fire ppl with prescriptions for marijuana because they test positive
