Have you been PM'd regarding the fact that you are not allowed to use it?

If you haven't been, feel free to use it.

If you are reffering to the size, it doesn't matter with avatars as long as it does not exceed the 50 kb limit - avatars get resized automatically.

If an avatar/signature was paid for by another user on this site, it is not allowed to be used by other users. This is known as ripping, which is essentially a form of scamming. Otherwise it would be okay to use.

Well since Legacy843 is a known user of the avatar ask him if he paid for it or if it was free.

If it is on some free smiley site then there isn't an issue.

If you're able to google it, you're able to use it, simple as that.
