Right, I agree. Them proving it or knowing it would be extremely difficult. You'd have to make it rather obvious. However, if they were to have a way to suspect/or detect it is bannable. I was temp banned on Path of Exile because I gave my friend all my gear(400ex worth of stuff). I had to talk to someone and explain he was in my guild(which he was and they verified) then I was unbanned. So saying a company can't suspect you of something is silly. They don't need exact proof to ban you. They can give you a blanket statement stating you violated the terms of service and are permanently banned and they do not have to disclose which condition you violated or disclose why.
