We'll the whole idea behind it is to allow rare weapons (which there are some fairly nice ones with minimal amounts of poison damage) to be used. The only allowed poison damage is on weapons/armor. If someone doesn't have poison damage on their weapon/helm/gloves/boots/belt/armor/rings/amulet (which I only think it can spawn on weapons/circlets/amulets for rares, but who would use most of those anyways) and they're turning people green then they're obviously breaking the rules.
Yeah, I don't think think it will be much of a problem.. It wouldn't be a common occurrence, and when someone did turn you green, and your life went down an unusual amount (or at all, cuz the cap should be set so that you hardly lose anything), then you check. Simple. It really isn't that big of a deal, but it would add just a tiny bit more variety (I have seen a handful of godly eth fools weapons around worth using that are disallowed under the current rules). The lack of variety has been a huge issue with the UGML ladder for the past 2 years now, and imo, all efforts should be made to make any changes necessary to "mix it up", encourage new builds, and perhaps, even go as far as removing certain items/runewords from the BM list to balance out other builds with pal vis / shaft setup. That's why many, including myself, got sick of it and left. I love tap duels, but not without some sort of strategy in designing builds (that's the real fun in it).
