US courts are pretty fond of circumstantial evidence. You usuallyy don't even need direct. Juries can draw inferences.

How is that relevant? Theft is theft. You aren't accusing them of stealing something you own (why it wouldn't be grand larceny), since Blizzard owns the items, but instead accusing them of much more general civil offenses. There's going to be massive fact questions as to whether the theft actually happened, and that's going to lead to a jury.

You're a fucking idiot if you think scamming some goober on D2 is going to a jury LOL. There would be absolutely zero evidence to show that the item was never given to the person after they paid. it would never even make it to court. Any lawyer or judge would laugh in your face trying to sue someone with D2 screenshots as "evidence"

One of the screenshots I had as evidence was a phone/facebook conversation which included him admitting to have scammed me.

Another is the western union charge back with confirmation from a western union representative.

In the end, all I know is that I got the item back and was able to sell it for fg.
