The intent behind the overly defensive rule is to discourage people from constantly running off map with no intention of attacking at all (some freaks that enjoy trolling and think it’s amusing…). If you are getting fohed, then it’s not considered overly defensive; there are already plenty of rules in place to nerf foh enough (nightmare, dmg limit, gm sorb). If your complaint is that you are having a hard time chasing someone who is fohing you, then I’d suggest changing your strategy.

I’m not sure how truly relevant this is if you aren’t even dueling on the ladder, and the people that are dueling aren’t appearing to have any issues.
