i was in the passenger seat of my buddies car, car decides to pass us on this county road, 55 mph speed limit we were doing about 62ish and the guy starting to come back into our lane with half his suv past us. my buddy turned the wheel we hit the ditch then the culvert and end over ended more than once and back on the wheels. that lil car still runs and drives straight. it was towed into town and i drove it back my buddies place few miles out of town. all she needs is a new radiator and would make a nice work beater!


the rear is all smashed too

Why turn into the ditch when that brake pedal is right there just chillen out waiting to be hit?

I would have let him hit me. Now it's out of pocket for the damages.

This. Even if the suv did try and merge with him there, he mostl likely would have stopped right after he nudged him. Pulling off into the ditch was probably the stupidest thing he could have done lol

Or, instead of willing accepting an accident, lay on the horn/hit the brakes/move to the right of the lane a bit/etc.
I had a car start cutting over in front of me today, just hit the horn and they stopped when they realized what they were doing. If they hadnt have stopped I could have easily slowed down enough to give them room without even hitting my brakes that hard.

Obviously you do what you can to avoid it, but if the choice is either do cartwheels in your car in a ditch or get hit by the other guy I'm getting hit by the other guy.

I definitely would have taken the other guy down with me. Simple pit maneuver, and it still would have looked like the other guy's fault. Unless ofc you're driving without insurance. In which case any damages to property, be it city or private, would be coming out of your pocket... even if you were seriously injured.
Did the other person stop? If not, with a full discription of the vehicle, they could have arrested the guy for causing an accident and leaving the scene/reckless driving.
