Well let me pretend to be a lawyer here. Whether or not Tony Stewart killed him on purpose is irrelevant to being charged with manslaughter. The deciding factor is if his actions contributed the kid's death. Obviously the kid being a retard running at the car was the reason he died, but I'd say the most important detail is deciding whether or not Stewart hitting the gas made the difference. If he hadn't hit the gas like that, would the kid still have been hit and killed? If he would have still run into the back tire anyway then it's not Tony Stewart's problem at all. But if hitting the gas closed the gap and caused the kid to get hit then Stewart's actions are responsible for the kid dying. On purpose or a complete accident, it would still be a contributing factor to his death. No matter what happens on the criminal side I bet Stewart ends up paying at least a few million to the kid's family.
do you know how you turn a sprint car? do you know anything about dirt cars at all? these arent your crown vic they are high horsepower and very lightweight and are built to run sideways not straight. when you are going through the corner the steering wheel goes from center to the right they arent turning left to go left. they also dont have transmissions in them its either stopped or going theres no in betweens.
also their right rear tire is larger to give them stagger and it sticks out a lot farther than the other tires (this is the tire that killed ward).
your pretending sucks because not only do you have to prove intent but you also have to prove that ward didnt put himself directly into danger by his actions. the video clearly shows him almost get hit twice and the second one was by a car directly in front of tony which ward took a step back before he went past. tony was slightly higher than the 45 car and you and i have no idea if tonys view was partially blocked by the 45 resulting in him not seeing ward until a split second before he hit him. perhaps tony saw him at the last second and hit the throttle in an attempt to turn his car left to avoid ward and ward was too close and was gonna be hit either way. you cant tell that from the video because its from across the track and only gives you basically a 1 dimensional view of the track where you cant tell the details about what happened.
