His insurance company will pay it then they'll get the garages insurance to pay them. They won't give his parents anywhere close to payout unless they have gap, which based on this thread they don't. They wouldn't sell it back to him for an amount that would allow him to make anywhere close to 18k haha. With the salvage title he wouldn't get much more than 18k after it was fixed up.

here in ny, the driver, despite not operating the vehicle at the time of collision, is still responsible. luckily for me, we both have geico, so its going to be much simpler. and no, its 100% not my fault, that was already established. ill know for 100% if the car is totaled in a few days when the claims adjuster inspects it, however im more than fairly certain itll be considered totaled because the mechanic im going to is a good friend of the families and he assured hell have it totaled, so im not really worrying too much about it.

update:

car got towed to my mechanic this morning where itll sit until geico sends a claims adjuster.

meeting my lawyer at 3

going to the rent a car place at 5

mechanic said sometimes they reimburse for full value on such a new car, hes seen it happen, providing receipts of course, or if that doesnt work, call geico and tell them i want the liberty of having them removed before a claims adjuster is sent out to check my vehicle, and they are the ones to pay for labor considering i am 100% not liable for the accident, which hes seen happen before as well.

Man I hope you actually get this fairytale treatment. They rep both parties. They aren't going to argue with themselves. You have been paying to insure a stock mustang GT. That is what they are going to cover.

i dont have my hopes set unrealistically high, what im going by is what ive been told from different people outside of this forum. do i expect them to write a check for exactly what i paid for, plus exact value of the mods, no. do i expect them to be writing a check near the value of what i paid, and some compensation for the mods if i cannot take them off, yes.

It varies state to state but at best you will get the devalued pay out for the mods even with receipts. I just read a thread on ls1tech where a guy got rear ended totalling hia camaro. Geico offered him $200 extra for the mod receipts he sent them totalling $6000.
