in before 2 years later you still havent gotten your settlement

when i hit the horse in my s10 it was an open and shut case because someones farm animal was on the highway they are automatically liable. i got screwed around for 2 years before i finally got my money. we were at the last step before i had to take him into actual court. just because its a black and white case doesnt mean they wont drag everything out to the deadline and make you wait a while before you get paid.

This. Unless there's an out-of-court settlement. That's when you know you've got 'em by the balls, and you can set the terms on payment.

im not even sure if the unlicensed part is a lawsuit. it will probably result in some sort of jail time from either the driver, the car wash owner or both. i dont know if sopranos can actually sue based on that, only thing he can sue for is the damages done and pain/suffering. the no incensed thing will prolly be a separate court trial with the state that is aside from what sopranos can claim. and once they haul it away, they arent supposed to touch anything on it other than what they are repairing. the car goes to the car shop and the car shop gives the insurance an estimate on how much it costs to repair. then the insurance company pays them to repair it, or they declare it as totaled. i honestly wouldnt be overly optimistic about getting the car totaled out. if the costs to repair the car is less than $28,000(or whatever it is currently worth) its going to get repaired. especially since no air bags were deployed and there wasnt any engine damage, it all seems to be body damage. Just saying you might want to not be looking to hard into a new car, as its a good possibility that your car is repairable for less than the cars worth. When my TC was wrecked i was thinking that it was going to be totalled out, it only cost like $4,000 to fix it.

obviously i dont know what other damage is done to it under the car, supension, frame ect, but just from a body perspective its repairable; heres a mustang with similar damage that didnt get totalled (the owner said it was a $9,000 repair)

Negligence and endangerment would be the only grounds for a civil suit. He can sue over something that goes to criminal court.

Exactly, but this is where the license comes into play. The fact that the car wash owner allowed an unlicensed driver to operate vehicles that were in his care is grounds for suit on sopranos' part. The owner of the truck also has pretty solid grounds for a law suit.

Thats not how totaling a car works. While they will total the car if the repair value is more than the car is worth, they'll also total it when its cheaper for them to pay out then auction the car off than to repair it. So the repair could be considerably less than the car is worth and it could still be totaled.

Ill be meeting with my lawyer this week, ill see what he says, I do know for a fact though that they are gonna lose money for their fuck up, how much depends.

And I want free car washes for life!

I would be so pissed if that happened to my car and they didn't total it out. I'd feel like my car was permanently tainted/molested
