If you let someone else drive your car, you arn't liable for the crimes they commit while they are in possesion of it... If he let me borrow his vette and i hit 5 kids in that intersection then drove his car in a ditch somewhere... he's not liable for the deaths of those 5 kids, he wasn't driving.

Did that unravel your warped views of motor vehicle laws, or help you understand that a parking ticket and a moving violation are 2 totally different things at all?

If he had no alibi it would be up to the jury.

Well in this scenario, he is clearly guilty of a rolling stop, that is what it is called here. By a matter of law he will be the one responsible because he allowed whoever your excuse "it wasn't me defense" driver to drive said vehicle. He's guilty and any reasonable person who watched the video will see, especially with the aid of attorneys for the prosecution and defense, that he did in fact, not stop for the red light. The fact that he may or may not have been driving said vehicle is irrelevant, due to the fact that he allowed someone else to use his vehicle. Which is why I cited the parking ticket example. If the said person who ran the red light also parked illegally and got a ticket when they were in a shop, the police would not automatically seem them park or return to the car.In my state running a red light is a civil infraction and not a misdemeanor, and you go to a magistrate and not even a judge. But the facts are the facts, hard to deny that his car, for which he is responsible, violated the law in the video. I rest my case.

this is pretty much spot on

I asked around and got some local feedback, a friend of mine got a ticket from the same light doing the same thing and she went and fought it and lost and had to pay the ticket + court fees. Good news is I don't get any points for the ticket since it was issued from a traffic control device and I can't be verified 100% as the driver. So even if I fought it and somehow won, the vacation day I would have to use to get off of work to go to court is worth quite a bit more than the $85, so I'm just going to pay it and be done with it.

LOL here in cali you can fight them in court and just say it wasnt yours. The judges dismisses them all the time since there is no way to prove that was you driving.

They are starting to take out all those cameras because everyone is fighting them

Is it even considered a moving violation since it carries no points? Any state in the country will dismiss it if you go fight it and claim it wasn't you. The idea is that most people will just pay the low amount instead of dealing with the hassle of spending a day or two off work and in court.

My guess is that it was just a traffic control camera, and they added the red light flag on it. They rely on people like you to roll over and pay, but anyone who knows a thing would never pay a ticket from that camera.
Most red light cameras that give out tickets are on the light/harness and facing the driver (on the light they are running) , and there is a reason they are placed as such.

they rely on their laws that stipulate the owner of the car is responsible.

anyone who knows the law realizes that common sense dictates a lot of it. common sense like laws like these vary all over and generalizing like you are doing is stupid.

common sense like before talking down to people you actually go learn about what you are talking about. for example if you would of looked up NJ law and read where the laws don't require driver ID in a lot of places.

but by all means keep talking out of ignorance because its sooooo helpful.

Common sense like OJ just left the scene of his wives murder covered in her blood.... right....
No, we're still in America subwoofer, and you still have to be proven guilty of a crime before you can be convicted.

Unless some lemming like you shows up to court, you're the special kind of stupid that would plead guilty to crimes they can't prove you did.

too bad NJ state law says otherwise. driver ID isn't required in a lot of places in NJ since they deem the owner responsible for whoever they let use the vehicle. unless it was stolen with a police report filed you pretty much have to admit you are responsible for the car and whoever was driving it.

In NJ most of my buddies have fought them and won. Never admit it was you, though. I'd rather pay the 85$ then sit in court all day and run the chance of paying the extra 35 or whatever it is.
