I'm unfamiliar with your trans but it sounds like 2nd and 4th are on the same drum. The clutch frictions are probably toast on that drum. When slippage occurs the TCM sets a code and skips those gears. When you shut it off the drive cycle reset until the next time it saw slippage. The dealership should see a 2nd/4th slippage code. It will probably need a complete rebuild.
Well that blows. I can't find anyone on the evo forums with the same issue. If this is the case the dealer is keeping the car and I'll get something else. I'll see what my results are on Monday

The dealer told me that if this ends up being trashed we will pretend like the sale never happened and he said he could find me a 5 speed one if I wanted. Not sure what I'll do, honestly 1 hour of light driving and likely a major issue? Kinda scares me away from an already pricey to maintain vehicle

I did test drive it, a pretty lengthy test drive too. It ran flawlesslly through it. I had no doubts about the cars condition while test driving it.
