This was the only mistake I made on my drivers test. I was sitting at a red light at the corner of two roads, two ladies are chatting on the sidewalk. One of the ladies is standing with one foot off the curb. I take a right when the light turns green.

The driving tester lady said she could have failed me for that.

So yeah, even if one foot is in the crosswalk (at least in NY) you cannot legally cross their path.

Pretty sure pedestrians always have the right of way, even if they are j walking.
