I don't have a custom tune. It's not wrapped. I've read that having an intake will cause boost creep.

they don't run a sniffer test and generally don't do a visual inspection in IL, either a catted or cattless DP should pass emissions from an OBDII with out a problem.
now if they do by chance do a visual, then a cattless with fail instantly, then the catted DP has a much better chance of passing.
imo passing emissions is a non-issue with a catted dp, thus i bought one.

now if you want to make some argument that cattless will really net more hp, go for it. i could care less about the extra 3 hp

cant be more true about IL my car was running rich and has no cats on it i still passed emissions because they didn't look
