My e46 didnt have power when it was cold after the start, was having" hiccups" as you mentioned. The reason being was a lambda probe/ oxygen sensor. After putting in a new one i had no trouble what so ever.

Thanks for the input I'll swing by my local auto parts store today and purchase an upper bank o2 sensor. Will update everyone after it has been installed.

O2 sensor was fine still can't seem to locate this problem <_<

Took the airbox and MAF all the tubing and DISA valve out today and everything checked out fine, still thinking it's a vacuum leak for an odd reason but I have no idea. Going to have the car smoked again by another shop within the next few days. If nothing else comes to mind before hand I'll go to BMW and find out what the small minor problem is and pay out there over priced fee's :mad:

A code P0171 may mean that one or more of the following has happened:
The MAF (Mass Air Flow) Sensor is dirty or faulty Note: The use of "oiled" air filters may cause the MAF to become dirty if the filter is over-oiled. There is also an issue with some vehicles where the MAF sensors leak the silicone potting material used to protect the circuitry.
There could be a vacuum leak downstream of the MAF sensor
Possible cracked vacuum or PCV line/connection
Faulty or stuck open PCV valve
Failed or faulty oxygen sensor (bank 1, sensor 1)
Sticking/plugged or failed fuel injector
Low fuel pressure (possible plugged/dirty fuel filter!)
Exhaust leak between engine and first oxygen sensor

not really sure if any of this relates to your problem though.

listen man the best place to go is forums for your car just google it and read around or even post and ask the bmw car fanatics there. they would be able to diagnose much better then most of these people including me. and this is solely because we dont own one just sayin and
forums is where the knowledge is at.

Sorry it took me a while to get back.

But I am also thinking this.

Do the carb cleaner, or ether trick. Spray little puffs around the engin3 bay and see if it influences revs at all.

Already have a topic on bimmerfest and I get more help and replies here. Those morons on bimmerfest just link you to 30 different links and send you running around in a circle. I have had more help on jsp than I have any other forum when it comes to car related problems. I'm by no means a mechanic but I know what to remove and how to do it properly. Thanks for your input though, and the replies in this thread are helpful at least they give me places to start. I appreciate every reply I receive, not to mention if it were not for OldAndy I wouldn't have figured out what was wrong with my Integra. So by no means will I rule anyone out, thank you all for the replies if you have any more suggestions please don't hesitate to direct me in the right way.
