Who is the lienholder on the bill of sale of a car when its between me ( the buyer ) and him ( the seller )?

I am going to pay ful amount for the car in cash.

and once i do buy the car and the car doesnt have a license plate, what should i do to drive it home?

Not sure where you live, but where I live you need registration transfer form from seller and his insurance paperwork. Then you would need to bring this to insurance agency and get them to transfer car into your name and get your plates.

im in ohio slap your plate on or if you have a notarized title you can get it home next day bmv and bam done

Your insurance covers you and not the vehicle? This doesn't make sense to me. In Canada your insurance Is vehicle specific, so you would not be covered by slapping plates on a vehicle you are not registered to. Not trying to argue just doesn't seem right.

wherever you have to go to do the title transfer, can usually offer temporary registration to get it home. Also if he doesn't owe money on the car there is no lien holder.

lienholder simply means if you owe someone money still and they want to place a lien against the title until you pay them in full. if you are paying cash and it wasnt a bank loan tied to the vehicle then there will not be a lienholder. if you borrowed money from abc bank then they will demand their name by put on the title as lienholder because you still owe them money. this insures if you dont pay the vehicle off as agreed to then they can repossess it at any time.

and dmv or courthouse whatever you use for vehicles will give you a new plate for the vehicle if it doesnt have one. in kentucky you are required to show proof of insurance before you can register a vehicle for the road.

This. Like someone else said each state/province will have different laws. In South Carolina I can obtain insurance on a vehicle before I purchase it. It's as simple as adding it to my policy and printing a card. I also do not need to have a plate on the vehicle to drive it from point A to point B after purchase so long as I have another vehicle registered and insured in SC. In that circumstance I would need the signed title or signed and completed bill of sale in the car with me. After the car arrives at point B it will need to be registered. If there is no lien as in your case, I'd simply carry the title and insurance policy number to the DMV AFTER paying the property taxes on the vehicle, fill out my Form-400, and get my tag. You cannot register a vehicle in SC until you pay the property taxes since we are a luxury tax state. Sales tax is paid at the DMV as well at a rate of 7% with a $300 max.

First off - do you know what lienholder means? Generally, lienholder is a 3rd party (bank) who has insurable interest in the car. Make sure you get the title if paying dude cash. If he has the car financed through a bank (a lease or monthly payments) he may not be able to sell it to you.

i would go a step farther and say show him the cash in hand but dont hand it over until you sign the title at the dmv or court house or whatever and its in your name. some shady fucker could have a bad title or something and get your money and youre fucked because the car wasnt in his name or something else.

as with jsp i would do transactions based on the 2/3 rule also ;)
