i'm quite sure you can report the one who initiated the vote, as long as they have no reason to kick you

There has been a lot of discussion surrounding this matter and a lot of debate over how we handle the issue of people being kicked unfairly from games.
We have attempted a number of different policies towards this and we have now made the decision that from this point forward we will not be moderating the use of the vote-kick feature.
It is our belief that if 9 other people agree to kick another player then it should not be something that we interfere with.
The issue of vote-kick is a controversial topic and we would advise you to use the suggestion forum if you don't like it - Please do make sure you use the existing threads:
http://forums.heroesofnewerth.com/forumdisplay.php?f=11 To clarify how vote-kick affects you: Your stats for the game are recorded but you are not given a leave for being kicked from the game due to a 10 player vote. If your team loses - you receive negative MMR but if they win you receive a gain in MMR - the game will always count as a loss however.
If you were vote kicked by your team (4 player vote) because you were marked "afk" then you are awarded a leave.
