If similarities are an issue, then it is easily argued that God instilled us all with a common moral ethos, so it would be natural that all man would come up with similar common law. You still have a chicken and egg problem; where did they get it from? The bible answers that question. The CoH allows for immoralities (prostitution, polytheism, polygamy, etc), while the Bible is morally superior, which also would explain that the Babylonians were pagans at the time, having borrowed from the ethos of the Judaic God, while changing other things to match their own desires. If you do some looking around, or compare the two yourself, you'll see stark differences to the point that it is obvious the Bible was clearly not borrowed from the CoH. However, I concede this could be argued from either side, but the point is, it's not conclusive.
Additionally, this is actually more support for the bible. Critics used to claim that the writings in Moses were far ahead of its time, too advanced, but the Code of Hammurabi shows that this is not so, and that this time period was not as "stupid" as we originally thought.
