Seems to me if there's a division (supposedly) of Church and State, that a punishment system based on the idea that there's such a thing as a soul would be wrong. If nothing lingers as they believe aren't we punishing innocent cells, electrical pulses in the brain etc of a crime they had nothing to do with?

I think you should actually understand the atheist position, because what you've presented is a straw Man either of your own creation or that you've been fed by somebody else.

Mine own creation to the point where I've never heard anyone else bring it up, for whatever little that's worth. Which is why I'm posting because I'm wondering why I've never heard anything before about it, at least of lengthy prison sentences. I can see where you'd say it's a straw man though, as the notion of a slap on the wrist or off with their heads as a punishment system would lead to anarchy.

There is no "atheist position" on any question except "do you believe in God?".
