https://www.realclearpolitics.com/video/2020/11/09/ben_rhodes_biden_having_phone_calls_with_foreign_leaders_about_the_agenda_theyre_going_to_pursue.html?utm_source=realclearpolitics.com_internal&utm_medium=internal&utm_campaign=realclearpolitics.com_internal&utm_content=290574700&utm_term=976893&crst=1610598548&wrst=1610598547

It appears, if we are to believe Ben Rhodes, that the Biden administration is in active conversation with a host of foreign leaders, and policy decisions are already being made. The issue at hand is that Joe Biden is not the president, and his future appointees obviously have no power within the current administration.

As I'm sure we recall, this was considered a serious violation of protocol, and possible criminal violation, when Michael Flynn engaged in similar discussions prior to the official Obama-Trump handover.

Personally, I have always been of the opinion that this is normal behavior that comes along with a transition of power, but opinions on this were very strong. Does Joe Biden need to be investigated for possible violations of the law?

Seems non-comparable to me. Your post alludes to the 'transition of power'; however, Trump has eviscerated that historical precedent and prevented Biden from getting the necessary knowledge, resources, and time to engage in what should have been a formal process.

Additionally, Flynn lied about his correspondence with the folks in Russia during late 2016. I doubt that Biden would, or would even need to, lie about whatever correspondence he has been engaged in.

That's something interesting to consider, who determines whether a transition has been "orderly enough" and to what extent ad hoc diplomacy is required?

I don't think Flynn's perjury saga is relevant here. The attack was that the call to Kisylak itself was somehow improper. I am trying to understand if that rule still applies.

Do we have the Biden transcript ? No
Was Biden a citizen like Flynn was ? Not really, he was president elect
Did Biden lied about it ? No
Who in History ever have been convicted following this act ? 2 people (1802 & 1852)

I think it safe to say that if the outgoing President denies the election and believes themselves to have 'rightfully' won, refuses to begin the transition process as a result, and holds out until the very nanosecond that they leave office, that the transition hasn't been 'orderly enough'--let alone orderly at all.

Is he interfering with the current administrations policy and asking for specific action that conflicts with the stance of the current government? Thats the reason why what Flynn did was bad.... He actively undermined the policy of the current government.

Flynn was targeted because he was willing and able to testify against the FBI's lawlessness. Only reason. One of the most deserved pardons in history.
