HS: In practice, the new law would lower the age of protection to 12 years - Courts would assess the voluntariness of 12-year-old children for sexual acts


The reform of the Sexual Offenses Act threatens to weaken the position of young victims, reports Helsingin Sanomat. This is the fear of several parties, including the Rape Crisis Center Tukinainen, during the opinion round of the law.
After the change in the law, the punishments for serious sexual crimes against children between the ages of 12 and 15 would be reduced.

However, this causes a problem in the case of sexual crimes against 12–15-year-olds, because according to experts, in the courtrooms, the voluntariness of 12-year-old children in sexual acts would begin to be assessed, and the focus would be on the victim instead of the perpetrator.
- There is general concern that the reform will significantly weaken the position of children aged 12–15, if the child is himself active and willing to participate in sexual intercourse. The ability of this age to decide about sexual activity is not as developed as that of an adult, the Northern Finland prosecutor's district states in its statement, according to HS.

If this is about 12 year olds fucking other 12 year olds then that's fine. Otherwise I cannot see how anyone thinks it's a good idea.
