The 'crime' of retention of classified documents makes no reference to obstruction or return of documents. If you steal documents and then return them, you are still guilty, it makes no difference.
Donald Trump was president of the united states with full plenary powers of classification and declassification, Joe Biden was not, he was vice president.
Furthermore, its laughable that Biden's dementia is cited as his shield against prosecution:
