Marriage is not a federal institution. Marriage is a State institution. And the States have differing laws.
To assume that one has a due process right that protects them indicates they have a "right" to get married in the first place. They do not. Marriage requires a license. If you have a right, such to speech, then needing a license is an infringement on that right.
I voted every 2 years to legalize gay marriage. I was pissed off when the SCOTUS used the bench to write a law that they had no authority to write. They invented a "right" that doesn't exist, and once again usurped States Rights, regarding a subject mentioned nowhere in the Constitution.
I'm very very tired of the SCOTUS violating my 10th amendment right to be self-governing. Read this very carefully, as many times as is required for understanding to sink in:
10th Amendment: "The powers not delegated to the United States by the Constitution, nor prohibited by it to the States, are reserved to the States respectively, or to the people."
