Not that easy, it has to be approved first, and if you are talking about a clearly proved deadly virus, not beans., you may go to jail (or executed) instead of getting a patent. You aware how Europe rejected GMO (hope so).

What can be patented is mRNA vaccines because labs use lipids macro molecules (as example) to protect RNA and this is patented methods. Not sure it could stay like this, like GMOs it can be copied (like generic drugs) and fall in public domain.
