https://www.huffpost.com/entry/dianne-feinstein-abortion-filibuster-carveout_n_62c736e9e4b02e0ac911b07dDianne Feinstein joins the list of Democrats embracing the call to arms to end the legislative filibuster so they can enshrine abortion protections in law at the federal level so that it can be immediately stripped away with another federal law the moment Republicans take control of congress after the midterms.
The logic goes something like this
The liberals got a court decision that usurped the power of the states and congress to regulate abortion. The liberals wanted to get more judges into the lower courts, so they went nuclear under Reid and ended the filibuster on judges, only for it to backfire spectacularly when Republicans got both more judges onto the lower courts and then felt justified in a tit-for-tat action to end the filibuster on the supreme court nominees. With the democrats very foolishly filibustering Gorsuch when Trump had an election tailwind, the entire party united behind him and extremely high approval ratings and an uncontroversial candidate- guaranteeing that even the likes of Romney and McCain would join in going nuclear to quash the hypocritical democrats. Leaving the door open for Kavanaugh and Barrett when the Republicans were in a much weaker position, a foreseeable future weaker position, given that I was predicting it back during the Gorsuch hearings. And now with Roe v Wade overturned, the democrats want to extremely absurdly foolishly end the legislative filibuster, knowing full well there's no such thing as a "carveout for one issue", because the moment they go nuclear that's end of the filibuster for
all legislation, same as judicial nominees. And the extremely absurdly foolishly part is because on top of the corrosive effects on our democracy and plunging us into civic danger, they want to do it right before the republicans retake congress. Which would leave only presidential veto to constrain Republicans for 2 years, and likely give them free rein in 2024-2026 at the rate we're going.
Of course, all this is back to a story about Dianne Feinstein who is being Weekend at Bernies'd anyway
Democrats actually have a decent chance of holding the Senate this fall. They will get wiped out in the Senate in 2024, when the "lucky class of senators" (who ran in three consecutive strong years for Democrats, 2006, 2012 and 2018) comes up for reelection in a presidential year. Manchin, Tester and the like will be toast.
They might also bank a lot on Trump being the GOP nominee again in 2024, and public opinion on him still being extremely polarized and hardened, with a slight but persistent majority loathing him. So there probably is a path to nuking the filibuster for abortion and getting away with it. It's of course still a foolish approach since the risk would be huge, as you pointed out, but also since allowing Republican hardliners to overreach on the issue is the far smarter long-term strategy for Democrats.
So yes, I agree with you that it's a stupid idea for Democrats to nuke the filibuster this summer, but there is at least some logic to it.
