i was being a bit sardonic, insofar that the skateboard wasnt my full point, its their focus on things that i dont think will win them the case, the skateboard among them.

I thought this would easily go the way of Kyle because if you simply ask most of the jurors to be in the shoes of Kyle and ask them if their response had been different, most would have likely used the weapon in defence, I think (obviously we don't know yet what they think)

Where most of us who are deemed the opposition for whatever reason said the defence will have to work in showing that Kyle was not there under malicious intent and proving that it was actually self-defence even though he willingly put himself in a dangerous situation and that is also what most of us have said the prosecution would go after, or thought they would anyway.

I think most of us are on the same page that his shots were defensive in nature.
