It is illegal, because you have to possess it to smoke it, whether it is enforced or not is another matter.
By your thinking jay walking is legal.

2011: R. v. Mernagh (Ontario Superior Court)

On 12 April 2011, Justice Donald Taliano found that Canada's Marijuana Medical Access Regulations (MMAR) and "the prohibitions against the possession and production of cannabis (marijuana) contained in sections 4 and 7 respectively of the Controlled Drugs and Substances Act" are "constitutionally invalid and of no force and effect".[18] The government was given 90 days (until 11 July) to fill the void in those sections, or the possession and cultivation of Marijuana would become legal in all of Ontario. This includes the non-medical use of the drug

If he lives in Ontario it IS legal.

Technically it's still illegal in other provinces, but you would never be prosecuted for it. If someone was prosecuted for it, they would rely on the above case as persuasive authority.

If you're using the internet from a sheltered location then you've signed the social contract.

You have to possess it to smoke it, but when it's gone, evidence that you smoked (smell, being high, etc.) can't get you in trouble. It is a little different if you're driving a vehicle and they have recently trained officers to test for stoned drivers.

Which I agree with. I smoke it in the comfort of my own home for the most part, that's how it should be.

Why wouldn't you think a social construct is real?

Social constructs are very real...justice is real, courage and bravery is real, honor is real, yet these aren't things you can point to.

You can't point to objective versions of eros, philla, or agape love, but they're real.

You seem to think that something being a social construct diminishes it's realness. Maybe that's why you're having so many problems with the concept itself.

I'm starting to understand why you don't 'get' it.
